

1 INTERPRETATION>
1.1 In these Conditions the following terms shall have the following meanings:
“Conditions” the terms and conditions set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between you and us; “Ice Rink” the Victoria Centre Ice Rink located in the Old Market Square, Nottingham; “Ticket” a valid entry ticket issued by us “we” / “us” / “our” [National Ice Centre]; “writing” includes email and facsimile transmissions; “you” / “your” the person who uses the Ice Rink pursuant to these Conditions.
1.2 Any reference in these Conditions to any provision of a statute shall be construed as a reference to that provision as amended re-enacted or extended at the relevant time. The headings in these Conditions are for convenience only and shall not affect their interpretation. A person who is not a party to the Contract has no rights under the Contracts (Rights of Third Parties) Act 1998 to enforce any term of the Contract.
2 TICKETS AND ADMISSION
2.1 We shall issue the Ticket at our quoted price to you in accordance with these Conditions which shall govern the use of the Ice Rink to the exclusion of any other terms and conditions. A written copy of these Conditions is available from our Box Office on 0115 853 3000 or from our website at www.national-ice-centre.com.
2.2 Upon purchasing a Ticket you agree to be bound by these Conditions.
2.3 Please check your Ticket upon receipt as Tickets cannot be refunded after purchase.
2.4 A valid Ticket must be produced to enter the Ice Rink and all Tickets issued are valid for one admission only.
2.5 The Ticket is valid only for the skating session at the Ice Rink specified on your Ticket and is not valid for use at any other times or on any other dates. Nor is the Ticket valid for a skating session at the National Ice Centre.
2.6 Removing the stub of your Ticket or altering or defacing your Ticket will invalidate your Ticket and render it void.
2.7 Tickets cannot be resold without our permission and we reserve the right to cancel any tickets that are resold without refund.
2.8 You are only permitted to enter and use the Ice Rink when wearing suitable ice skates.
2.9 We reserve the right to cancel or suspend a skating session at any time on the grounds of public safety – for example, adverse weather conditions may make skating unsafe.
2.10 There are no refunds if a session is cancelled. If a session is cancelled or suspended, an alternative session shall be offered at the Ice Rink. In the event that rescheduling at the Ice Rink is not possible then an alternative skating session at the National Ice Centre will be offered.
2.11 You must leave the Ice Rink at the specified time on your Ticket
2.12 We reserve the right to refuse admission or eject any person without any refund for unsafe or inappropriate behaviour or if we consider you to be under the influence of alcohol.
2.13 Our Rink and Security staff are entitled to carry out a reasonable search of you and your belongings in the interests of safety.
2.14 We reserve the right to restrict the number of people allowed on the Ice Rink at any one time.
3 RULES AND REGULATIONS OF USE
3.1 You should skate within your limitations. Speed skating, acrobatic tricks and other dangerous activities are not permitted and may result in you being ejected from the Ice Rink.
3.2 You are not permitted to bring food and/or drink onto the Ice Rink.
3.3 Littering on the Ice Rink is prohibited.
3.4 Animals are not permitted on the Ice Rink.
3.5 You are not permitted to carry children on the Ice Rink.
3.6 All bags, umbrellas and other similar items are not to be brought onto the Ice Rink. A limited number of lockers are available for hire from the Skate Hire at the side of the Ice Rink.
3.7 No children under the age of 2 years old are allowed to use the Ice Rink. All children between the ages of 2 and 7 years of age must be accompanied at all times by an adult over the age of 18 years on the Ice Rink. (maximum of 4 children per adult).
3.8 On entering the Ice Rink you consent to any photography, filming, or recording authorised or arranged by us for promotional purposes. Should you be on the Ice Rink at the time we shall use reasonable endeavours to inform you that such photography, filming, or recording is to take place.
3.9 Rink staff are provided for your safety and you must follow their instructions at all times.
3.10 All injuries and potential hazards e.g. holes in the ice, should be reported to the Rink Staff immediately.
3.11 You must always skate in an anti-clockwise direction.
3.12 No chain of skaters should exceed 3 people.
3.13 The throwing of snow or ice or the chipping or digging of holes in the ice is prohibited and will result in ejection.
3.14 Our obligations under these Conditions shall be suspended during the period and to the extent that we are prevented or hindered from complying with them by events beyond our reasonable control (including, without limitation, strikes, lock-outs, labour disputes, failure of equipment, adverse weather conditions and compliance with any law or governmental order, rule, regulation or direction).
4 WARRANTIES AND LIABILITY
4.1 Subject to the conditions set out below we warrant that we will provide the Ice Rink and associated services with reasonable skill and care.
4.2 Where any valid claim in respect of a breach of the warranty given under clause 4.1 is notified to us in accordance with these Conditions, we shall be entitled to offer you another Ticket free of charge or at our sole discretion, refund to you the price of the Ticket)
4.3 All users of the Ice Rink skate at their own risk and we shall not be liable for any loss or damage other than death or personal injury arising from our own negligence
4.4 We shall not be liable for any injuries or loss caused by the wilful acts or omissions or negligence of any third party except in circumstances where we have been negligent
4.5 We shall not be responsible for lost or stolen Tickets.
5 GENERAL
5.1 There are certain terms implied into our relationship with you in respect of the Ice Rink which we cannot exclude or limit. For example, under the Sale of Goods and Supply of Services Act 1983 (as amended) we must ensure that we supply the Ice Rink and related services with reasonable skill and care. Nothing in these Conditions affects these statutory rights.
5.2 No waiver by us of any breach of these Conditions by you shall be considered as a waiver of any subsequent breach of the same or any other provision.
5.3 These Conditions shall be governed by the laws of England and the parties hereby agree to submit to the exclusive jurisdiction of the English courts.
